The group will conduct its function in an orderly manner and in full compliance with the policies of Simmons Promotions Inc. and with all applicable laws, ordinances and regulations. The group agrees to have the individuals of the group vacate the designated function space at the ending time indicated. Function space is reserved based on contracted numbers of attendees. Management reserves the right to alter such function space. Should there be any extraordinary changes in your requirements as outlined, appropriate rental charges may apply.
Our special events coordinator will coordinate all aspects of your event and will serve as your principal contact. Any questions or concerns the day of the event may be directed to the manager on duty.
Outside Service Fees:
Outside service fees arranged by the special events coordinator will be subject to handling charges. The group is responsible for payment of any deposits or cancellation fees by the outside service.
Banquet Food & Beverage Policies:
We do offer a preferred catering service, you may choose between one of our approved caterers approved by Special Events Coordinator. You may however use your own caterer in which a $100.00 kitchen fee will be assessed, with $50.00 being returned after the event has completed and kitchen is returned to it’s starting condition. You must purchase all of your beverages through Simmons Promotions Inc. in the case of a private label wine or champagne; the Special Events Coordinator can fulfill the order. Menu selections, room set up requirements, and the Special Events Coordinator should receive all other special arrangements at least 30 days prior to the scheduled event. Guaranteed number of attendees must be received at least 72 hours in advance. Attendees in excess of the guaranteed will be served subject to availability. The group will be charged for the guaranteed or actual number served, whichever is greater. All food & beverages are subject to a 15% gratuity.
It is the policy of Simmons Promotions Inc. that no one under the legal age of 21 will be able to consume or purchase alcoholic beverages. Please make sure that all members of your party are aware of this policy and that Simmons Promotions Inc. has the right to request I.D. from anyone. If an I.D. cannot be produced upon request he/she will not be allowed to drink alcoholic beverages. We will prosecute anyone under the legal age of 21 caught drinking on the premises; this includes but is not limited to inside our facility or on any part of our grounds outside of the building. It may be required that anyone of the legal drinking age wear a drinking bracelet. Simmons Promotions Inc. has the right to obtain or require security guards for any or all events.
Decorations and linens can be rented through Simmons Promotions Inc. and must be confirmed at least 72 hours prior to the event. In the event that you are providing your own decorations, you will need to coordinate you decorating schedule with the Special Events Coordinator. Simmons Promotions Inc. will not guarantee decorating time 48 hours prior to you event date.
Please keep in mind the following guidelines while planning you decoration:
Sand, rice or Kitty Litter cannot be used for weighs in balloons or other decorations. Food coloring, ink or dye in floating candles or vases, are prohibited. Paper or metallic confetti, potpourri or any decoration that is difficult to sweep up may not be used. Tape or staples of any kind may not be used on walls, floors, or ceiling. In the event any of the above is done without authorization and any damage is suffered, the cost or repair and or replacement will be billed to the group.
Each party hereby agrees to indemnify, defend and hold the other harmless for any loss, liability, costs or damages arising from actual or threatening claims or causes of action resulting from the gross negligence or intentional misconduct or such party or its respective officers, directors, employees and agents, contractors, members or participants, provided that with respect to officers, directors, employees and agents, such individuals are acting within the scope of their employment agency, as applicable. In no event shall either party be liable for any indirect, special or consequential damages, including lost revenues or profits arising out of or in connection with performance or failure to perform under this agreement.
Terms of Contract:
Deposit will be due on or before due date on your contract or contract will be null and void. The deposit is non refundable. All cancellations must be received 60 days prior to the event date or additional fees in the amount of 50% of your estimated bell will be incurred. Final payment will be due upon departure.
In addition to any rights or remedies set forth in the agreement or any rights or remedies at law, the group will be responsible for all reasonable costs, attorney’s fees and expenses that may be incurred by Simmons Promotions Inc. in enforcing this agreement.
Your signature on this agreement establishes this event on a definite status and represents your commitment to hold the event as outlined herein at the Palace Ballroom.
